Miller-Meeks reintroduces act protecting energy manufacturers from wildfire lawsuits

Congresswoman Mariannette Miller-Meeks has reintroduced the Limiting Liability for Critical Infrastructure Manufacturers Act, aiming to protect American energy manufacturers from lawsuits related to wildfires. This legislation seeks to ensure the reliability of the power grid and strengthen the domestic supply chain. Representatives Thomas Tiffany and Robert Latta have joined her in this initiative.

“No manufacturer should be driven out of business for building the components that power our homes, hospitals, and national defense,” stated Miller-Meeks. She emphasized that the bill aims to protect those who make essential grid components from natural disasters beyond their control. The goal is to strengthen domestic manufacturing and secure America's energy future.

The background provided indicates that as wildfires become more severe, manufacturers of critical infrastructure face increased legal risks despite following safety protocols. Without protection, these companies might shut down or relocate production overseas, potentially weakening America’s grid and increasing energy costs.

The proposed legislation would shield manufacturers from wildfire-related lawsuits unless there is clear evidence of willful misconduct. It applies specifically to companies in the "critical manufacturing sector" as defined by federal cybersecurity law and aligns with definitions under the USA PATRIOT Act.

This bill was initially introduced during the 118th Congress as H.R. 9608.

Industry leaders have expressed support for this legislation. Wes Smith, President and CEO of NAED, noted that it would help sustain progress in reshoring manufacturing of critical grid components by providing greater certainty and protection against frivolous claims. Spencer Pederson from NEMA highlighted that this measure would offer much-needed liability protection amid increasing wildfire threats.

Both organizations appreciate the leadership shown by Representatives Miller-Meeks, Tiffany, and Latta in introducing this important piece of legislation aimed at securing critical infrastructure in America.
