Senator Merkley questions Dan Bishop's nomination amid concerns over OMB practices

Today, Senate Budget Committee Ranking Member Jeff Merkley delivered an opening statement at the nomination hearing for Dan Bishop, who is being considered for the role of Deputy Director of the Office of Management and Budget (OMB). The hearing took place in Washington, DC.

Senator Merkley addressed Mr. Bishop directly in his prepared remarks: "Thank you, Mr. Chairman. And welcome, Mr. Bishop." He highlighted the significance of the OMB's role since President Trump assumed office, stating that it has been central to numerous decisions that have altered federal government operations. These changes include program cancellations, grant suspensions, fund retractions, department reorganizations, and federal employee dismissals.

Merkley emphasized that many actions taken by the OMB under Trump's administration are seen as violations of both law and the Constitution. He outlined existing legal avenues for reorganizing federal spending: Congress can pass new laws upon presidential request; the President can request a rescission under the Budget and Impoundment Control Act of 1974; influence future budgets through advocacy; and veto Congressional bills if there is disagreement over spending.

The Senator criticized OMB's disregard for these tools and its decision-making process that allegedly breaches legal and constitutional boundaries. Addressing Bishop's nomination, Merkley expressed concerns about whether Bishop would support or oppose such practices if confirmed.

Merkley also mentioned the importance of exploring Bishop's background during the hearing to assess his suitability for this influential position. This includes examining his views on legality concerning impoundments and freezing federal funds, as well as past actions related to whistleblowers.

Concluding his statement, Merkley said: "I look forward to discussing these and other issues with you, Mr. Bishop."
