Guidance on the new ATV and UTV law and what it means in the City of Davenport

Although Iowa House file 2130 takes effect this Friday, July 1, 2022, there is no change to the use of ATVs/UTVs in City of Davenport as Davenport city ordinance 10.68.230 regulates the use of ATVs/UTVs within city limits. This recent state law change legalizes the use of ATVs/UTVs on a limited number of roadways with in the State of Iowa and allows local cities to regulate usage in addition to state law.

In the City of Davenport, pursuant to Davenport City Ordinance 10.68.230, the following are permitted uses of ATVs/UTVs:

  • ATVs and UTVs may only be operated on private property between the hours of 7:00 a.m. and 10:00 p.m.
  • While being used in a properly-authorized parade
  • When an ATV/UTV is crossing a street pursuant at a 90 degree angle to the flow of cars/trucks using the street
  • When the ATV/UTV is operated in the ditch at least five feet from the edge of the road by an abutting property owner/owner’s family member

Golf cars/carts are not a part of this bill and operation is not permitted on any streets in Davenport, except during a properly-authorized parade.
